Welcome to JobPitch! These Terms and Conditions govern your use of the JobPitch platform. By accessing or using our services, you agree to be bound by these terms. Please read them carefully.

1. Definitions

For the purposes of these Terms and Conditions:

  • "Platform" refers to the JobPitch website and all associated services
  • "Pitcher" refers to job seekers who create video pitches
  • "Scout" refers to employers or recruiters who post job opportunities
  • "Pitch" refers to video content created by Pitchers
  • "Job Post" refers to job opportunities posted by Scouts
  • "We," "Us," "Our" refers to JobPitch
  • "You," "Your" refers to the user of our Platform

2. Acceptance of Terms

By creating an account, accessing, or using JobPitch, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

If you do not agree with any part of these terms, you must not use our Platform.

3. Eligibility

To use JobPitch, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

4. User Accounts

4.1 Account Types

JobPitch offers two types of accounts:

  • Pitcher Accounts: For job seekers to create video pitches and apply to job opportunities
  • Scout Accounts: For employers and recruiters to post jobs and review applications

4.2 Account Registration

You agree to:

  • Provide true, accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms and Conditions
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Upon your request

5. Content and Intellectual Property

5.1 Your Content

When you upload video pitches or post jobs, you retain ownership of your content. However, you grant JobPitch a worldwide, non-exclusive, royalty-free license to:

  • Host, store, and display your content
  • Share your content with relevant users (Pitchers with Scouts and vice versa)
  • Use your content for platform improvement and marketing purposes

5.2 Content Restrictions

You agree NOT to upload, post, or transmit content that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights
  • Contains offensive, discriminatory, or illegal material
  • Violates privacy rights or discloses confidential information
  • Contains viruses, malware, or harmful code
  • Promotes spam or unsolicited communications

5.3 Platform Content

All JobPitch branding, logos, graphics, and platform features are owned by JobPitch and protected by copyright and trademark laws. You may not use, copy, or distribute our content without written permission.

6. Pitcher Responsibilities

As a Pitcher, you agree to:

  • Create genuine, truthful video pitches representing your skills and experience
  • Only apply to jobs you are genuinely interested in and qualified for
  • Respond professionally to Scout inquiries
  • Respect the confidentiality of any Scout information shared with you
  • Not misrepresent your qualifications, experience, or availability

7. Scout Responsibilities

As a Scout, you agree to:

  • Post only legitimate job opportunities
  • Provide accurate job descriptions, requirements, and compensation details
  • Comply with all applicable employment laws and regulations
  • Treat Pitcher applications and video pitches confidentially
  • Not discriminate based on protected characteristics
  • Not misuse Pitcher contact information or video content
  • Remove job posts once positions are filled

8. Prohibited Activities

You may not:

  • Use the Platform for any illegal purpose
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Platform
  • Scrape, data mine, or use automated systems without permission
  • Impersonate another person or entity
  • Create multiple accounts to manipulate the Platform
  • Interfere with the Platform's proper functioning
  • Post pyramid schemes, chain letters, or multi-level marketing

9. Payment Terms

Note: If you offer paid features or subscriptions, customize this section with your specific pricing, refund policy, and payment processor details.

JobPitch may offer paid features or subscription plans. By purchasing these services:

  • You agree to pay all applicable fees
  • Payments are processed through secure third-party payment processors
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to change pricing with notice
  • Subscriptions auto-renew unless cancelled

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using JobPitch, you consent to:

  • The collection and processing of your personal data as described in our Privacy Policy
  • The use of cookies and similar technologies
  • Communications from us regarding your account and our services

11. Disclaimers and Limitation of Liability

11.1 Platform "As Is"

JobPitch is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

  • Uninterrupted or error-free service
  • The accuracy or reliability of user-generated content
  • Job placement or hiring outcomes
  • The conduct of other users

11.2 Employment Relationships

JobPitch is a platform connecting job seekers and employers. We are not:

  • A party to any employment relationship
  • Responsible for employment decisions made by Scouts
  • Liable for the conduct of employers or job seekers
  • An employment agency or recruiter

11.3 Limitation of Liability

To the maximum extent permitted by law, JobPitch shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • User content or conduct
  • Third-party services or links

Our total liability shall not exceed the amount you paid to JobPitch in the past 12 months, or £100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless JobPitch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content posted on the Platform

13. Third-Party Links and Services

JobPitch may contain links to third-party websites or services. We are not responsible for:

  • The content or privacy practices of third-party sites
  • Any damages arising from your use of third-party services

Your interactions with third parties are solely between you and the third party.

14. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the Platform. We will notify users of material changes via:

  • Email notification to your registered address
  • Prominent notice on the Platform

Your continued use of JobPitch after changes constitutes acceptance of the modified terms.

15. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of JobPitch shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.1 Dispute Resolution Process

Before initiating legal proceedings, you agree to:

  1. Contact us to attempt informal resolution
  2. Participate in good faith negotiations for 30 days
  3. Consider mediation if informal resolution fails

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and JobPitch regarding the use of our Platform.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
